CS3 is old enough, that different rules may apply, if  it works then different rules do apply. But, for CC, and possibly CS6, if you do not deactivate, you will not be able to use it until you get t straightened out with Adobe.  So when in doubt, deactivate, it will then be available for reinstalling.

Yes, you need to deactivate it as well. Each Adobe program needs to be deactivated to avoid reinstall problems…

When my hard drive crashed I just installed PS CS3 on the new disk, it seems to work. Did I do something wrong or illegal?

I'm putting a new hard drive in my computer. I've deactivated PSCS 6. I also have Adobe CC. Do I need to do anything with that?
